API License Agreement

Note: This API License Agreement (“Agreement”) governs your use of the Xentaura API, effective upon subscription. By accessing the API, you agree to these terms.

1. License Grant

Upon subscription, Xentaura grants you a non-exclusive, non-transferable license to access and use our API to retrieve First Smart Crypto Index data for your internal business purposes only, subject to this Agreement and rate limits (e.g., 1,000 requests/second).

2. Restrictions

2.1. You may not resell, redistribute, or create derivative products (e.g., competing indexes, ETFs) using API data without our written consent.

2.2. Rate limits apply—exceeding these may result in pause or suspension.

3. Service Availability

3.1. Outages: In rare, unpredictable scenarios, the API may experience outages (short: up to 3 hours, medium: up to 6 hours, long: over 6 hours). We strive for 99.9% uptime but are not liable for disruptions or losses.

3.2. Credits: For outages, you will receive a credit of twice the time and average API calls impacted. For scheduled maintenance (announced in advance, infrequent, necessary for improvements), credits will be 1.5 times the impacted time and calls.

3.3. No Guarantee: We disclaim liability for API downtime unless caused by gross negligence.

4. Data Usage

API data is provided “as is” from our Indexes and third-party sources. We are not liable for inaccuracies unless due to our gross negligence.

5. Termination

We may terminate your access for violations, with 30 days’ notice for non-violations. Non-payment suspends access immediately.

6. Limitation of Liability

Xentaura’s liability shall not exceed the amount paid for the API in the past 12 months, except where prohibited by law.

7. Governing Law

This Agreement is governed by Delaware law, with disputes resolved via arbitration in Delaware, USA.
